📖 Paribhasha: Part I Bharat ke naam, territory aur naye States ke admission/formation se sambandhit provisions cover karta hai.

🔑 Mukhya tathya: Source ke anusaar, India “Federation” nahi balki “Union of States” hai.

Article 1 — Name and Territory of the Union

Article 1(1)

“India, that is Bharat, shall be a Union of States.”

Article 1(2)

States aur unki territories First Schedule me specified hongi.
(The States and their territories shall be as specified in the First Schedule.)

Article 1(3): Territory of India

  1. Territories of the States
  2. Union territories specified in the First Schedule
  3. Such other territories as may be acquired

Articles 2 & 3

Article 2 — Admission or Establishment of New States

Parliament law ke through Union me new States admit ya establish kar sakti hai, on such terms and conditions as it thinks fit.

Article 3 — Formation / Alteration of States

Parliament law ke through:

  1. territory separate karke, States/parts ko unite karke, ya territory ko State ke part se unite karke new State form kar sakti hai;
  2. State ka area increase;
  3. area diminish;
  4. boundaries alter;
  5. name alter kar sakti hai.
⚠️ Exam Trap — Article 2 vs 3: Source ke anusaar Article 2 foreign territory ko India me incorporate karne se related hai, jabki Article 3 existing State me changes se related hai.
⭐ Mahatvapurn: Article 3 subject matter wala Bill President ki prior recommendation se introduce hota hai. President Bill ko concerned State legislature ko views ke liye refer karega. Source ke anusaar 5th Constitutional Amendment ne President ko State legislature ke views ke liye time limit set karne ki power di.

Article 4

Articles 2 aur 3 ke under banaye gaye laws First aur Fourth Schedules ke amendment ka provision kar sakte hain.

🎯 Article 4(2): Article 2/3 ka aisa law jo First/Fourth Schedule amend karta hai, Article 368 ke purpose ke liye constitutional amendment nahi maana jayega; source ke anusaar ise Parliament me simple majority (more than 50%) se pass kiya ja sakta hai.
🔢 Number Trap: Indian territory ko cede karne ke liye source Article 368 amendment ki requirement batata hai — Berubari Union case, 1960.

Bombay Reorganisation Act, 1960: Bombay ko Maharashtra aur Gujarat me bifurcate kiya; dono 1 May ko statehood commemorate karte hain.
🔑 1 November: Source ke anusaar Karnataka, Kerala, Andhra Pradesh, Chhattisgarh, Haryana aur Madhya Pradesh apna statehood 1 November ko celebrate karte hain.

India me 12 years residence: preceding 14 years me 11 years + application se immediately before 1 year. Source ek Indian language (8th Schedule) jaanne ki condition bhi deta hai.

3. By Descent

Indian origin, currently living in another country.

4. By Registration

Indian-origin individuals, spouses of Indian citizens, ya minor children jinhone India me 7 years reside kiya ho.

5. By Incorporating a Territory

Country new area par sovereignty extend kare aur government us territory ke people ko citizens declare kare.

Loss of Citizenship

1. Renunciation

Voluntarily Indian citizenship give up karna.

2. Termination

Source ke anusaar voluntarily other country ki citizenship acquire karna without informing.

3. Deprivation

Fraud/false documents se citizenship acquire ki ho, ya war ke during enemy country ko help ki ho.
